Agreement to Terms

Welcome to FocusDown! These Terms of Use ("Terms") constitute a legally binding agreement between you and FocusDown ("we", "our", or "us") governing your use of the FocusDown mobile application. By downloading, installing, or using FocusDown, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the application.

Description of Service

FocusDown is a productivity application designed to help users manage their focus time through timed sessions, ambient soundscapes, music integration, and progress tracking. The app uses device motion detection to automatically start sessions when the phone is placed face-down.

Subscriptions & Auto-Renewal

FocusDown offers the following auto-renewing subscription options:

• FocusDown Pro Yearly: $14.99 per year with a 7-day free trial
• FocusDown Pro Monthly: $2.99 per month

Subscription Terms

• Payment will be charged to your Apple ID account at the confirmation of purchase
• For the yearly plan, the 7-day free trial converts to a paid subscription unless canceled at least 24 hours before the trial ends
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your Account Settings on the App Store after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

User Responsibilities

You are responsible for maintaining the security of your device and any data stored within the app. You agree to use FocusDown only for lawful purposes and in accordance with these Terms.

Intellectual Property

FocusDown and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. The app's design, including animations, sounds, and visual elements, may not be reproduced without permission.

Third-Party Services

FocusDown may integrate with third-party services such as Apple Music, Spotify, and analytics providers. Your use of these services is subject to their respective terms and conditions. We are not responsible for the content or practices of third-party services.

Analytics & Data Collection

By using FocusDown, you consent to the collection and processing of usage data as described in our Privacy Policy. This includes device information, app usage patterns, session data, preferences, and feature engagement. We use this data to improve FocusDown and provide you with a better experience.

Disclaimer of Warranties

FocusDown is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of FocusDown.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes through app updates. Your continued use of FocusDown after changes constitutes acceptance of the new Terms.

Termination

You may stop using FocusDown at any time by uninstalling the application. We reserve the right to terminate or suspend access to the app for violations of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
